Minutes of the Town of Barnes Planning Commission September 10, 2009 4:00PM

Planning Commission members present: Dave Pease, Mitch McGee, Diane Rupnow Members Absent: Gene Ratzel, Dick Webb. Alternate absent: Duke Marten. Public Present: Jim Wargin, Robert Fierek, Max Fierek

The meeting was called to order by Chairman Dave Pease. Roll call to establish quorum. Agenda read.

Motion (McGee/ Rupnow) to dispense with the reading of the minutes from the last meeting and to approve the minutes. Motion carried. Motion to approve the agenda (Rupnow/ McGee). Motion carried.

Public Comments: None . Zoning, Land Use Applications: 1- Second Star LLC, Robert Fierek, for a short term rental approval on the guest cabin at 51340 Lake Road. Motion (Rupnow/McGee) to approve the request. Discussion. Robert spoke regarding the property. The cabin is set back from the lake and the owners would like to help offset the costs of the property with the rental income. Motion carried. 2- Robert A. Rucker, 2061 Lake Road. To exceed height limit with a structure of 38 feet on his property. Motion (McGee/ Rupnow) to approve the request. Discussion. Jim Wargin spoke as the agent. The architectural drawing was done before they were aware of the 35 foot height restriction. It would be very visible from the lake. There is a pond there that is also very sensitive to development. If there was not grading done to create the walk out basement, the height would be within the limits set. Motion denied.

Motion (McGee/ Rupnow) to adjourn at 4:37. Motion carried.
