REGULAR BOARD MEETING
July 19, 2011
 
 
Chairperson Lu Peet called the Regular Board Meeting to order at 6:30PM. The Pledge of Allegiance to the Flag was recited. A Roll Call was taken to establish a quorum and verification of public notice was asked of Deputy Clerk-Treasurer DeLizio by Peet. Donna Porter was absent; Chris Webb arrived at 6:35PM. Everyone else was present. 
 
Motion (Meinke/McGee) to approve the agenda, the minutes of the last Regular Town Board meeting and to dispense with the reading of those minutes. Motion carried.  The agenda is as follows:

Motion (Meinke/McGee) to approve the Treasurer’s report as read. Motion carried.
 
Clerk Correspondence      
Chair Lu Peet read a letter from the Department of Workforce Development regarding a special assessment which is due to states needing to borrow from the Federal Unemployment Trust Fund. An assessment of .15% of an employer’s taxable payroll will be assessed and billed in August.
 
 
Public Comment Session – 3 Minute limit for those not on the agenda
Dave Pederson talked about needing a dumpster for the ball tournament. Waste Management requires a full month’s rental, and it will cost the Lion’s club $400.00 to go with another company. The town’s dumpster would be too small to use. Meinke said non-profits are no longer eligible to use the Transfer site. Webb, Peet and Meinke will try to have another option for the Lion’s club within a week.
Greg Martin talked about the missing Pickerel Lake dock, per Bob’s email the DNR has it and is repairing the dock. Greg will follow-up with the DNR.
Bill Patza spoke regarding the Cranberry Lake Road discontinuance. The town now only snowplows, they don’t maintain it. The homeowners there only want to have the town snow plow it, but if they are going to discontinue it they should leave it in good repair.  Bob Lang, the Town Roads, Foreman, said they cannot maintain it without widening it. They have no turn-around there so would have to back up for a quarter mile.
               
Department Head Reports:
                Highway
The big news this month is the storm. The worst hit roads were South Shore Road, River Road, Pease Road, Robinson Lake Road, Sweet Lake Road, and Witches Bay Road. Dave and I each headed out with a loader and pushed trees until 3am. We owe the fire department a huge debt of gratitude. The whole department was out with chain saws cutting up trees and helping the ambulance do welfare checks on people stranded by the down trees. The road crew spent a couple of days cleaning up the trees remaining on the right of way the following week. We will be applying for reimbursement from the Wisconsin Disaster Fund.
 
We received a couple of day’s worth of help from the work crew from the Gordon Correctional facility so we started tree removal on Tars Pond Road. Over half of the road is opened up. Stumping, shaping, and grading of that section of road should be done by the end of the week.
 
We installed 27 feet of new boat ramp at the Island Lake boat landing the week before the 4th. We now have clearance from the DNR to remove sand from the Robinson Lake boat landing. 
 
Extensive work continues on the northern roads. Dave has been working on 43 road to prepare it for the gravel that will be placed on it thanks to funding from the county. Last week we dug up the area of collapsed road bed on George Lake Road with Del Jerome. We removed a bunch of stumps and whole trees about 7 feet down. That area will need to settle for a year or two before it can be surfaced.
 
Mitch and I met with Shawn Hasleau from the DNR to discuss many water issues around town. The culverts on Mulligan creek will be lowered significantly to return the stream to its original elevation. Tars Creek will probably need to be rerouted slightly to allow for a longer and larger culvert. The south River Road bridge approach will require multiple permits because of lake bed and wetland issues. Finally, the Outlet Bay Bridge removal project may be eligible for funds from the Fish and Game division of the DNR. All of these projects are ongoing.
 
The town hall received upgrades to the exit lights and outdoor lighting and is now in compliance.

 The Town Board of the Town of Barnes, in Bayfield County, Wisconsin, by this resolution, adopted by a majority of the town board on a roll call vote with a quorum present and voting, and proper notice having been given, resolves and orders as follows:
The process under chapter 82, Wis. Stats to discontinue a highway in the town described as follows is hereby initiated: .24 miles of gravel road lying in Government Lot 4 of Section 30, Township 44 North, Range 9 West in Bayfield County Wisconsin. 
A scale map of the land that will be affected by this application is attached.
Adopted this 19th Day of July, 2011.

Motion (McGee/Webb) to approve Resolution # 11-09 as read. Roll call vote taken: all present responded yes. Motion carried.  The hearing will be at 6:00 before the September 20th Town Board Meeting and will offer more chance of discussion on the subject. All property owners who will be affected will be notified. Meinke discussed the option for the property owners to pay to have someone privately plow the road.
 
                                Approve Resolution to discontinue Smart Road

 The Town Board of the Town of Barnes, in Bayfield County, Wisconsin, by this resolution, adopted by a majority of the town board on a roll call vote with a quorum present and voting, and proper notice having been given, resolves and orders as follows:
 
The process under chapter 82, Wis. Stats to discontinue a highway in the town described as follows is hereby initiated: .29 miles of gravel road lying in Government Lot 2 of Section 18, Township 44 North, Range 9 West in Bayfield County Wisconsin. 
 
 
A scale map of the land that will be affected by this application is attached.
 
Adopted this 19th Day of July, 2011.

There was more discussion from the audience on discontinuing of Cranberry Lake Road. Webb questioned why we needed to go through the process as it is a very expensive process. Lang has not been able to reach the landowner at the end of this road. This may not go through but he wanted to make sure all landowners were aware of the tentative discontinuance.

 The Town Board of the Town of Barnes, in Bayfield County, Wisconsin, by this resolution, adopted by a majority of the town board on a roll call vote with a quorum present and voting, and proper notice having been given, resolves and orders as follows:
The process under chapter 82, Wis. Stats to discontinue a highway in the town described as follows is hereby initiated: .23 miles of sand road lying in Government Lot 5 of Section 2, Township 44 North, Range 9 West in Bayfield County Wisconsin. 
A scale map of the land that will be affected by this application is attached.

Motion (Meinke/Webb) to approve Resolution # R11-10 to discontinue South Call O Wild Road.  Again there was much discussion from the audience regarding Cranberry Lake Road. Since the floor was not opened for discussion Peet reminded everyone that the resolutions start a process and at the public hearing they will be allowed ample time to discuss their concerns. Roll call vote taken: all responded yes. Motion carried.
                               
Jim Baaken, Ayres and Associates – update on Boat Landing grants
Bakken reported the Waterways Commission will meet on August 3rd to discuss our grant request. He will present their findings at the August Town Board meeting. There is a Sport Fish Restoration Fund that will give a grant also, but that would delay the process into next year, possibly April. McGee questioned the impact on spawning. Lang brought up the road ban issue, but if possible, heavy equipment could be brought in before the road ban was placed. This new grant will be discussed further at the August meeting.
 
 
                                Approval of Resolution # R-11-11 Municipal Disaster Proclamation
This resolution is needed to apply for funding from the Wisconsin Disaster Fund on work done after the July 1st storm. 
 
Motion (Meinke/Webb) to approve signing the Resolution. Roll call vote taken: all present responded yes. Motion carried.  Lang will coordinate with Elaine to apply for funding. Renz will need to get information to him on all the firefighters who helped out during the storm.
 
                Cemetery
Sexton Dave Schiess reported there was one cremation last week. Bob Brennan is now doing the mowing as their current service was discontinued.
               
                Fire and Ambulance Department
Since the last Town board meeting the ambulance has had 14 calls since the last meeting.

Driver training was accomplished and well received by members. No totals available for fourth of July yet I will have those figures for you at next meeting. We do have over half of the shirts sold at this time. Thanks to all for your support.
The Fire Department has responded to 6 runs this month.

 I was originally in favor of phone service for the Highway Department versus buying radios. As you recall I believe the original cost to replace all or install radios in all equipment in highway Department I believe was around $28,000 for purchase and installation in equipment and to replace the one in the hall and the Town Hall.
Since the July Ist storm damage I have changed my mind because as we set up incident command the command post needed to talk to the equipment in the field ( truck and loaders) and we were unable to do so because Loaders only had portables available to them and truck radio is very old and poor condition. Probably came over on the Mayflower. This is also the truck the Fire Department responds to scenes with the rescue sled for ATV and snowmobile accidents.
I have been in contact with DSC in Superior. We have a chance to purchase the radios for $410.00 and they are 64 channel radios so we would be able to have all mutual aid channels available and also replace the one at the hall and the Town hall which would also make all radios narrow band complaint for the Sept 1st change over to narrow band as the ones in the Highway trucks now would not be able to be used after that date because they do not meet the narrow band requirement.
I figure we could get this all done for $5000.00 compared to the $28,000 as earlier suggested by the radio company. I am requesting the Town Board place this on the agenda for the July 25th meeting and transfer $5000.00 from the General fund to do this. I believe only two of the radios will be for Fire and Ambulance one for the Town and the 7-8 others for the Highway. We will also save on the installation cost as we can have the Fire Mechanic do the installation at a much reduced cost then having DSC accomplish this. Remember in a situation as on July 1st, those highway department vehicle basically become emergency vehicles and the difference in getting Emergency Vehicles (Fire, Ambulance and Sheriff) to those places that need them. We were Lucky this last storm no one was injured. I hope our luck continues but if it does not I want to be ready.
 
                Constable
Lu Peet read the Constable’s report: 5 alarms from the Sheriff and private alarm companies. 4 fireworks complaints, all had permits, 1 firearm complaint, resident target shooting on his property, 1 personal watercraft complaint, operating too close to shore on the Middle, 1 respond to multiple requests for service following the severe storms, attended 4th of July parade for traffic control, 1 deer hit on 27, 2 animal complaints, lost pets, and 1 noise complaint in Island Lake area.
 
Committee Reports
 
                Eurasian Water Milfoil committee
Ingemar Ekstrom spoke that the DNR has determined there is still 6 acres with Milfoil on Sandbar lake. A plan is being developed. Tomahawk Lake has 1 acre of milfoil, a plan is being worked on by the DNR. George Lake appears to have milfoil, plants have been sent to be verified. 
 
                Parks Committee
                No report was given
 
                Cell Tower Communications Committee
                Mike Tremblay spoke as representative of the committee. Per the Land Use Commission any changes to the plan have been postponed until their annual review in October.
 
Land Use Planning Commission
Pease said the commission addressed the cell tower recommendation and decided to postpone it. The proposal as previously proposed was too restrictive or extreme. There is a safety issue for a large part of town and cell phones are needed.
 
Citizen’s Request for Service: 
 
Request by Mike Kuebler expressing concern over thistles growing along Twin Bay Road
Bob Lang will follow up with Mr. Kuebler on this. Next year we will need to publish a Class II notice per statutes on or before May 15th. We have never done this previously but will need to now.
 
Approval of a Temporary Class “B” Picnic License for the Lions Club for August 13th and 14th Ball Tournament
 
Motion (Webb/McGee) to approve the Class B Picnic License request by the Lion’s Club. Motion carried.

1 Year New License for: Megan Waterhouse and Stephen Schultz
DeLizio reported the fees have been paid but background checks came back on both with more arrests than were reported on their applications. Per Elaine Brustad, she recommended denial and she could call them to come back in and correctly fill out their applications. 
 
Motion (Webb/Meinke) to table the request by Megan Waterhouse until she could re-submit a corrected application. Motion carried.
