Regular Town Board Meeting July 20, 2010
MINUTES OF THE TOWN OF BARNES REGULAR BOARD MEETING JULY 20, 2010 Chairperson Lu Peet called the Regular Board Meeting to order at 6:33PM. The Pledge of Allegiance to the Flag was recited. A roll call to establish a quorum was asked of Peet. All Board members were present. The Agenda had been posted online and in three public places and verified by the Clerk-Treasurer, Elaine Brustad. Peet asked for a motion to approve the July Agenda, approve minutes of the Last Regular Board Meeting and a motion to dispense with reading of the minutes. Motion (Webb/Meinke) to approve the agenda, the minutes of the last Regular Town Board meeting and to dispense with the reading of those minutes. Motion carried. Barnes, Michael P Barnes and Sharon Wright One year License Renewal for: Anne Wikan Two Year New License Applications for Karna Kiggins, Wesley Little, Tabitha Adolphson and Tom Krob One Year New License for Dena Monaghan and Stephen John Anderson Issues Timeline Update All Department Heads are encouraged to be at the Regular Board Meetings All Department Heads and Committee Heads are to submit a written report to the clerk By Friday evening prior to the Board Meeting. The Town Board reserves the right to solicit information from Department heads and Committee heads only, without opening the floor to discussion. Motion (Porter/McGee) to approve the Treasurer’s report as read. Motion carried. Voucher’s Approval Motion (Porter/McGee) to approve the voucher’s as presented. Motion carried. Clerk Correspondence Brustad read a letter received from Jan Erickson of Arvada, Colorado thanking the Town for the outstanding fireworks on July 4th. She also commented on the patriotism she noticed from all during the National Anthem. Brustad read another letter received from an anonymous summer resident thanking those who worked hard to present the beautiful display of fireworks on the 4th of July. They also commented on the music played during the festivities that respected cocaine throughout its length. They hoped that in the coming years we would follow a patriotic theme throughout the program and leave out the drug culture celebration. Brustad received a WITC Board Appointment letter which will be posted on the bulletin board out front for anyone to view. Approval to write a letter to Bayfield County Treasurer on behalf of Dan and Lucy Augustine o waive the late fees for their unpaid 2009 taxes Brustad received a request from the Augustine’s to send a letter to the Bayfield County Treasurer to ask that he reduce or waive the interest fees for their 2009 unpaid taxes. She said the Augustine’s had petitioned the Board to reduce their taxes as they felt they were too high, however, per statutes they had to pay the tax first so the Board could not address their request. The Assessor was giving them a credit on their 2010 taxes to compensate for the high 2009 taxes. Motion (Webb/Meinke) to write a letter to the Bayfield County Treasurer asking for consideration from him in reducing their interest charges on the 2009 taxes. Motion carried. Public Comment Session – 3 Minute limit for those not on the agenda Marcia Ritter wanted to thank everyone involved for putting the flags out again on the light poles and also for the fireworks display. Suzette Tremblay also wanted to express her distaste in the music selections for the fireworks display. She talked with many who felt the same way. Department Head Reports: Highway The past month was spent doing a lot of roadside mowing, grading, and constantly fixing washouts due to a couple of heavy downpours. The reconstruction work on James and Smith right of ways have been completed along with culvert installation and erosion control treatment. Reconstruction on the first .8 mile of the Moore Rd is progressing well and side and back slope work should be completed tomorrow. The ski trail has been mowed. Loan approval for new plow truck The approval has been given to purchase the plow truck and loan amount given but official approval had not been given to obtain a loan in the amount of $80,000.00. The Resolution and loan documents needed by the Board of Commissioners of Public Lands were read and introduced By Chris Webb. Motion (Webb/McGee) to obtain a loan for the plow truck in the amount of $80,000.00. Roll call vote was taken and all responded with a yes. Motion carried. Cemetery We had two burials in May, Ann Foat and Linda Pease. We have been working on the new fence and the sign for the cemetery. Pat Tierney will be buried August 7th and Zelma Marshall will also be buried in August. Fire and Ambulance Department Since the last Town board meeting the ambulance has had ten calls. 1 – Medical transport intercept with Gold Cross 1 – ATV accident Town of Highland Transferred to Gold Cross 1 – Burn intercept with Gold Cross 2 – Trauma falls transported to Hayward 1 – Medical Town of Highland Patient transported by private vehicle No transport 1 – Great Divide mutual aid to our area or transport 1 – Mutual aid to Great divide 1 – Respond to Cabin Fire treat firefighters in rehab area and provide water 1 – Respond with Fire for power line down on Outlet Bay Road Everything going well with Ambulance Service I have started a new contract with Verizon for phone service with the ambulance at a government rate of .06 cents a minute and no monthly contract you just pay for what you use and the sending of EKG readings to the hospital will begin after August 4th. Since the last meeting the Fire Department has responded to two Fire Calls 1- Cabin Fire Highway 27 1 – Power line down on Outlet Bay Road The fourth of July Fireworks went off fine with no problems. We again will have to in November or December pay ahead of time for the Fireworks per our contract. Elaine and I will take care of it again. Have not heard any complaints as of yet. Constable There were 4 alarms, 2 PWC complaints on the middle, 12 firework’s complaints, all had permits. 1 assist motorist on highway 27 near the Ounce River, 1 firearm complaint; property owner was target shooting safely on his own land. Followed the 4th of July parade. Committee Reports EWM Committee Ingemar Ekstrom reported testing on Tomahawk Lake still revealed no Eurasian Water milfoil. They are working on grants to submit in August. The “Rapid Response Plan” will be submitted as one grant request. Lee Wiesner worked on this plan, which would provide a grant in place in case we needed to quickly treat a lake where Eurasian Water Milfoil was discovered. The “Clean Boats Clean Waters” grant request is for 3 years, 2011 through 2013, and will be a 75/25 match. Then there will be the research grant for Sandbar Lake. The Governor will be up in this area towards the end of August, and he may be looking at programs here in Barnes. Resolution # 10-04 for Grant Funding 2011, 2012 and 2013 This Resolution will be submitted with the three grant applications. Motion (Meinke/Porter) to adopt Resolution # 10-04 for grant funding. Roll call vote taken and all responded yes. Motion carried. Town Hall Maintenance Committee Committee Chairman Mike Tremblay reported the committee was unable to meet this last month. The engineer is working on the engineering plans and drawings for the entryways. Land Use Planning Commission Plan Commission Chairman Dave Pease reported three items were discussed at their meeting last Thursday. Ruprecht’s Special Use permit application they felt was in harmony with the land use plan and recommended approval by the Board. Regarding the Class A Special Use permit application by David Schiess; it has adequate setback from the lake, zoning has approved of this and it complies with the Land Use Plan. The Special Use application by John Flayton meets all requirements from zoning and is in harmony with the land use plan. They recommend approval of all three. The Plan Commission plans on working on any changes needed to the plan starting in September. Motion carried. Citizen’s Request for Action: 1) Jeff Fullington request to grade Grassley Road and gravel for Deer Grove Road Jerry Witt spoke and said Grassley road had been graded. After much discussion it was referred to the Roads committee for review along with item # 4. 2) Greg Dalbec request to have Jerry Witt meet with him to correct drainage issues from Smith Lake Road onto his driveway Witt said it s a non-issue, he spoke with Mrs. Dalbec and their driveway is fine. 3) Greg Roman request for an ordinance to address trash, refrigerators, cars and general appearance of residences in Barnes Mr. Roman was not present so this issue was not addressed. 4) Tom and Bobbie Pieters request to have Beaver Court maintained so they can access their lot on Beaver Court The Pieters’ were both present and spoke on the issue. They are trying to sell their lot and without access it is nearly impossible to do so. Motion (McGee/Meinke) to refer this issue and the Deer Grove Road Issue to the Town Roads Committee for review. These will be placed on the timeline also. The committee will reconvene before the next Town Board meeting. Motion carried. 5) Tony Rogers regarding a nuisance dog Mr. Rogers asked for assistance in keeping Mike O’Keefe’s dog contained. There was a confrontation and he felt Mr. O’Keefe’s demeanor was uncalled for. The Board will speak to him at the next town board meeting in August regarding his side of this incident. Open Bids for Sealed Hot Mix Asphalt for paving on Martin Road, James Road, Smith Lake Road and Moore Road One bid was received for the project from Northwoods Paving. Paving of all 4 roads with two inches of hot mix would be 5015 tons at $59.98 per ton or a total of $300, 799.70. Option to place base material on Moore Road, Smith Lake Road and James Road would be 5728 ton at $5.67 per ton for a total of $32,477.76. Witt said he asked for this as he does not have the time to do it. Total for the whole project with the option is $333,277.45. Motion (McGee/Meinke) to accept the bid from Northwoods Paving in the amount of $333, 277.45 for the asphalt and gravel work. Roll call vote taken and all responded yes. Operator’s Licenses: Two Year License Renewals for: Jenneane Lois, Larry Lois, Bobbie Shemwell, Florence Prickett, George F. Barnes, Michael P Barnes and Sharon Wright Motion (Porter/Meinke) to approve the renewals for the above people for a two year Operator License. Motion carried. One year License Renewal for: Anne Wikan Motion (Porter/McGee) to approve the one year license for Anne Wikan. Motion carried. Two Year New License Applications for Karna Kiggins, Wesley Little, Tabitha Adolphson and Tom Krob Brustad said all had paid their fees, background checks for Karna Kiggins and Wesley Little had additional arrests that they did not reveal on their application. Motion (Webb/McGee) to table these two until next month and have them come in to redo their applications. Motion carried. Motion (Webb/McGee) to approve the applications for Tabitha Adolphson and Tom Krob. Motion carried. One Year New License for Dena Monaghan and Stephen John Anderson Brustad said these two were fine, background check was ok, they had paid their fees, and both had their certificates. Motion (Meinke/Porter ) to approve the one year licenses for Dena Monaghan and Steven John Anderson. Motion carried. Issues Timeline Update Town owned land: DNR has funds that could be used for Potawatomi Town Hall Maintenance – work in progress Boat Landings – met with DNR (Spangeberg) have not heard back yet from him. Greg Martin said Conservation Club would volunteer their efforts to do a quick fix unless original permit allows us to fix whenever we need to. Spangeberg is checking on that.
