SEC. 2-1 REGISTRATION
OF VOTERS.
Registration
of all voters shall be required pursuant to the provisions of Wis. Stat. Sec.
6.14 and other applicable sections of the Wisconsin Statutes, and no person
shall be eligible to vote at any primary, general, local or special election
hereafter to be held in the Town of Barnes, unless such person shall be duly
registered, or until the provisions of Chapter 6 of the Wisconsin Statutes with
reference to non-registered voters shall have been complied with.
SEC. 2-2 ACCEPTANCE
OF FIVE PERSON BOARD.
The
number of supervisors for the Town of Barnes is five (5). Three (3) supervisors, one of which is
designated as chairman, shall be elected in odd-numbered years and two (2)
supervisors shall be elected in even numbered years.
SEC. 2-3 APPOINTED TOWN CLERK AND APPOINTED TOWN
TREASURER.
(a) The Town Board of the Town of Barnes did on April
6, 2004 provide for the appointment by a majority of the members-elect of the
town board, as defined in Sec. 59.001(2m) to fill the office of Town of Barnes
Town Clerk, effective at the end of the Clerk’s current term.
(b) The
Town Board of the Town of Barnes did on April 6, 2004 provide for the
appointment by a majority of the members-elect of the town board, as defined in
Sec. 59.001(2m) to fill the office of Town of Barnes Town Treasurer, effective
at the end of the Treasurer’s current term.
SEC.
2-4 COMBINED OFFICE OF TOWN
CLERK/TOWN TREASURER
The Town meeting of the Town of Barnes did on November
18, 2003 combine the offices of Town Clerk and Town Treasurer of the Town of
Barnes. The new title of the office
will be “Town Clerk/Town Treasurer.”
SEC. 2-5 DUTIES OF
CONSTABLE.
The Town Constable of
the Town of Barnes shall have the following duties:
(a) The Town Constable of
the Town of Barnes shall keep and preserved the peace within the Town of
Barnes, and shall have the full peace powers to arrest and apprehend any person
for felony or breach of peace pursuant to Sec. 59.28 (2001-2001) Wis. Stats.,
and for purposes of carrying out such duties shall be considered a peace
officer as defined in Sec. 939.22(22), (2001-2002), Wis. Stats.
(b) The Town Constable of
the Town of Barnes shall suppress unlawful assemblies with peace powers within
the Town of Barnes pursuant to Sec. 947.06(2001-2002) Wis. Stats., and any Town
of Barnes Ordinances in conformity with this section.
(c) The Town Constable of
the Town of Barnes shall direct and regulate traffic and make arrests for
violation of traffic crimes and regulations of Chapters 194 and 341 to 349,
(2001-2002), Wis. Stats., any Town of Barnes Ordinances in conformity with
these chapters and for purposes of carrying out such duties shall be considered
a traffic officer as defined in Sec. 340.01(70), (2001-2002), Wis. Stats.
(d)
The Town
Constable of the Town of Barnes shall serve within the County of Bayfield any
writ, process, order or notice, and execute any order, warrant or execution
lawfully directed to or required to be executed by any court or officer.
(e)
The Town
Constable of the Town of Barnes shall attend upon sessions of the Circuit Court
in the County of Bayfield when required.
(f)
The Town Constable
of the Town of Barnes shall inform the District Attorney of the County of
Bayfield of all trespasses on public lands on which he or she has knowledge or
information.
(g)
The Town
Constable of the Town of Barnes shall impound cattle, horses, sheep, swine and
other animals at large on the highways in violation of any duly published order
or ordinance adopted by the Town Board of the Town of Barnes.
(h)
The Town
Constable of the Town of Barnes shall cause to be prosecuted all violations of
law of which he or she has knowledge or information.
(i)
The Town
Constable of the Town of Barnes shall perform all other duties as required by
law.
(j)
The Town
Constable of the Town of Barnes shall cause to be enforced and prosecuted all
violations of the Town of Barnes Town Ordinances of which he or she has
knowledge or information.
(k)
The Town
Constable of the Town of Barnes shall act on behalf of the Town Board of the
Town of Barnes as directed to:
(1)
See that orders
of the Town Board of the Town of Barnes and ordinances of the Town of Barnes
are obeyed.
(2)
See that peace
and order are maintained in the Town of Barnes.
(3)
Obtain
necessary assistance, if available, in case of emergency, except as provided
under Chapter 166 (2001-2002), Wis. Stats., for emergency government.
SEC. 2-6 NONEXCLUSIVEITY OF TOWN CONSTABLE.
The
jurisdiction powers and duties of the Town Constable of the Town of Barnes as
stated herein shall not preclude the Town Board of the Town of Barnes or any
other Town officer of the Town of Barnes from proceeding under any ordinance or
law or by any other enforcement method to enforce any ordinance, regulation or
order.
SEC. 2-7 NUMBER OF
TOWN CONSTABLES.
The
number of Town Constables of the Town of Barnes is one (1).
SEC. 2-8 REQUIREMENT THAT ALL TAXES, ASSESSMENTS AND FORFEITURES BE PAID AND CHECKS CLEAR BEFORE ANY LICENSE IS GRANTED.
(a)
No person,
partnership or corporation shall be issued a license or have renewal of a
license previously held if any of the following apply:
(1)
a person,
partnership or corporation or any person, partnership or corporation owning the
real estate or personal property used in the licensed activity has any
delinquent real or personal property taxes on the real or personal property
involved in the licensed activity in the Town of Barnes;
(2)
a person,
partnership or corporation or any person, partnership or corporation owning the
real estate or personal property used in the licensed activity has any
outstanding assessments or forfeitures on the real or personal property
involved in the licensed activity owed to the Town of Barnes;
(3)
if payment is
made by check, until the check is processed and clears the bank.
(b)
For those
persons, partnerships or corporations subject to refusal to grant a license or
renewal thereof, pursuant to this ordinance, said person, partnership or
corporation shall have opportunity to be heard as follows:
(1)
The Town Board
of the Town of Barnes shall conduct a hearing on the issues.
(2)
Written notice
of the hearing shall be served not less than three (3) days nor more than ten
(10) days from the date of the hearing.
